Concept of
Electoral Bonds:-
The recipient parties could encash
these bonds through their bank accounts, with no obligation to disclose the
identity of the donor, not even to the Election Commission of India (ECI).
Electoral bonds, functioning as promissory notes, were bearer instruments
devoid of any buyer or payee information.
Advantage of EB:-
Electoral Bonds eliminates generation of BLACK MONEY during
ELECTION.
Ruling of Supreme Court:-
In
a recent Supreme Court ruling in the matter of Association for Democratic
Reforms & Anr. v/s Union of India, Electoral Bond Scheme (EBS/ Scheme) was
declared as unconstitutional, including certain amendments to section 182 of
the Companies Act, 2013 (“CA”), amended vide the Finance Act, 2017 as arbitrary
and violative of the Constitution of India (COI).
The
SC ruling does not declare “political donations” per se as unconstitutional or
invalid, what is rendered violative of constitutional rights is the Electoral
Bond Scheme and the amendments to section 182 of CA vide Finance Act, 2017
permitting unlimited and anonymous contributions to political parties.
Consequence after SC ruling:-
Election Commission published Electoral Bonds data submitted
by SBI before the Supreme Court’s deadline. The tempest on a cup of suspicion
raked up by Congress was over.
Adani or Ambani didn’t appear on the list! Lottery
company facing ED probe is the top buyer.
BJP is the biggest recipient of Electoral bonds, with over
₹6,060 crores. The second largest beneficiary was Trinamool Congress with
₹1,610 crores, followed by Congress (₹1,422 crore) and BRS (₹1,215 crore).
In the list published by the Election Commission based on
the data submitted by the State Bank of India, none of the Adani Group
companies or Reliance Group bought any Electoral Bonds. This means, the group
may have donated to political parties, but they didn’t use the Electoral Bonds
ROUTE for the purpose.
Rahul
Gandhi has been alleging that all policies of the Modi government are to
benefit only two BUSINESS HOUSES e.g. Adani and Ambani, -- that blame fell flat on
face.
Most of the companies, mentioned in the published list are well-known, except a few.
The list includes several well-known companies, like the
Bajaj group, Bharti Airtel, DLF, Jindal Steel, Vedanta etc. But the names of
top purchasers of Electoral Bonds are several relatively lesser-known companies.
The top purchaser of electoral bonds is Future Gaming and
Hotel Services Private Limited, the company bought a total value of ₹1,368
crore. The second largest purchaser is Megha Engineering and Infrastructures
Limited with ₹821 crores. The third place was occupied by Qwik Supply Chain
Private Limited.
Notably, the lottery company Future Gaming & Hotel
Services Private Limited is facing a probe by the Enforcement Directorate in a
money laundering case. The agency had attached assets worth ₹409.92 crore of
the company and its various sub-distributors in relation to the case originally
registered by Kolkata Police. The company is the sole distributor of paper
lottery organised by the states of Sikkim and Nagaland that runs the popular
‘Dear Lottery’.

Controls ED, CBI, Income tax, SEBI.

Rs 6060/- crore
Rest of the parties:-- No govt in centre/ have govt in 11
states/ LW Anti capitalists / don't control any central agencies.

Rs 5500/- crore
