THE STORY OF LOVELY KHATUN
THE STORY OF LOVELY
KHATUN
SARASIJ
MAJUMDER
Trinamool
Congress (TMC) leader Lovely Khatun, who served as the Pradhan of the
Rashidabad Gram Panchayat in West Bengal's Malda district, was stripped of her
post by the local Sub-Divisional Officer (SDO) following allegations that she
is an illegal immigrant from Bangladesh.
The whole
story is narrated below.
The
Background and Controversy:
The
controversy erupted after her defeated political rival, Rehana Sultana, filed a
petition in the Calcutta High Court, accusing her of being an illegal Bangladeshi
immigrant who procured forged Indian documents, and got elected.
What Investigations
revealed:
Identity
Discrepancy: Investigations unearthed that Lovely Khatun's real name is Nasia (or
Nasifa) Sheikh and that she allegedly entered India without a valid passport.
Forged
Documents: She is accused of forging her father's name (listing him as Sheikh
Mustafa instead of her actual father, Jamil Biswas) to obtain Indian documents,
including a birth certificate and a voter ID, to conceal her Bangladeshi
nationality.
Political
Career: Khatun originally contested and won the 2022 Panchayat elections on a
Congress ticket. Following her victory, she joined the TMC and was appointed
head of the Rashidabad Gram Panchayat.
Recent
Developments: Following the High Court’s order and district administration
reviews, the local SDO officially removed her from her post as Panchayat
Pradhan. The issue sparked intense political friction in West Bengal, with
opposition leaders demanding strict investigations into how she managed to
serve as an elected public representative on FORDGED IDENTITY DOCUMENTS.
Lovely
Khatun is currently remaining in West Bengal, India, and has neither been
arrested or deported, though stripped of her position as the head of the
Rashidabad Gram Panchayat.
Her current
status: No Criminal Detention. Following the revocation of her OBC certificate
and official removal from her political post, no immediate legal steps were
taken by local authorities to arrest her or legally deport her to Bangladesh.
Opposition
leaders, including members of the BJP, have publicly criticized the
administration because she was allowed to remain free and initially retained
her position as a general member of the Panchayat despite citizenship findings are fraudulent.
Voter
Status Under Review: During the State Inquiry Registry (SIR) processes
conducted in West Bengal, her name was not completely removed from the official
draft voter lists, but her final voter status and Indian citizenship
eligibility have officially been marked as "under trial/pending
evaluation" (বিচারাধীন) by electoral authorities.
Political
Protection Allegations: Local opposition groups have alleged that she continues
to stay in the region under the local protection of TMC party workers. Local
TMC members have reportedly faced
accusations of trying to pressure Booth Level Officers to re-verify, and rework
her local identification documents.
The
Calcutta High Court issued legal mandates requiring local administration
probes, which ultimately forced her removal from office, though she has filed a
subsequent appeal. The legal progression
and structural overview of the orders issued by the Calcutta High Court feature
several key components:
1.
Mandatory Investigation and Report Demands
Sought Administrative Probe: Following a petition filed by her political
rival, Rehana Sultana, a Single-Judge Bench initially ordered the
Sub-Divisional Officer (SDO) of Chanchal, Maldah, to conduct an official
inquiry.
2. Scrutiny
of Identity Papers: The court mandated a strict verification of how her 2015
Aadhaar card, 2018 birth certificate, and subsequent voter registration papers
were acquired.
3.
Validation of Administrative Removal & OBC Certificate Cancellation: The
judicial pressure directly resulted by the SDO cancelling her Other Backward
Classes (OBC) certificate on grounds of documentation forgery.
The
administration's investigation report regarding Lovely Khatun—ordered by the
Calcutta High Court and executed by Chanchal Sub-Divisional Officer (SDO)
Shouvik Mukherjee on behalf of the Maldah District Magistrate's (DM)
office confirmed extensive identity and document fraud.
4. Dismissal
Upheld: Because her eligibility for the reserved Panchayat seat was voided by
the administrative order, the Single Judge upheld her forced removal from the
post of Pradhan of the Rashidabad Gram Panchayat.
5. Recent
Appeals and Division Bench Proceedings, Appeal Lodged by Khatun: Disgusted by
her dismissal, Lovely Khatun moved an appeal (M.A.T. No. 540 of 2025)
challenging the Single Judge’s decision.
6. Gram
Panchayat Joined as Party: A Division Bench consisting of Justice Rajasekhar
Mantha ordered the official inclusion of the Rashidabad Gram Panchayat as a
necessary party respondent to the ongoing legal dispute.
District
Magistrate Directive: The High Court directed the District Magistrate (DM) of
Malda to formally review the statutory appeal and stay application submitted by
Khatun regarding her removal.
Judicial
Status: The findings were submitted back to the Calcutta High Court, where her
overall citizenship status and potential criminal liabilities for illegal entry
remain categorized as under trial / sub-judice.
WHAT
EMERGE:
This must
be one of the many cases, where illegal immigrants are staying in India because of our weak administrative, and
judicial procedure, even after detection!! I request present CM of West Bengal
to get these cases handled fast.
