ADITI—DEBRAJ
ADITI—DEBRAJ
SARASIJ
MAJUMDER
Former
Trinamool Congress (TMC) MLA and singer Aditi Munshi, along with her husband
Debraj Chakraborty, are currently facing serious allegations regarding
disproportionate assets and discrepancies in income details submitted in election affidavits.
The couple
approached the Calcutta High Court to secure anticipatory bail to avoid arrest
which was denied, but granted partial immunity from arrest for a brief period.
And Court advised them to co-operate with investigations which will continue.
The
accusations and resulting legal actions include the following key details:
Disproportionate Assets and Income Concealment:
The
Accusation: A formal police case was registered at Baguihati police station
based on a complaint filed by BJP MLA
Tarun Jyoti Tiwari. The complaint alleges that Munshi and her husband acquired
properties and amassed wealth that are disproportionate to their known sources
of income. The amount we hear in You-Tube/social media is Rs.100 Crore.
State
Allegations: State counsels have claimed that the couple's bank accounts showed
sudden, massive transactions—including funds moved from multiple accounts just prior
to the elections. The state has also alleged that this wealth was amassed
through extortion and land grabbing.
Defense:
The couple's legal team has argued that the FIR was politically motivated,
noting it was filed immediately after the election results were declared. They
contest that any issue regarding income disclosure should fall under the
purview of the Income Tax Authorities rather than being treated as organized
crime.
May Be—But False Declaration Of Asset Filed By A Contestant Is
Crime Under Section 318(4) Of The BNS, And Non Bailable.
High Court
Intervention: On May 22, 2026, the Calcutta High Court heard the anticipatory
bail pleas. Justice Joy Sengupta directed the state to produce evidence
supporting the allegations and file a comprehensive progress report on the
investigation. The court verbally instructed the state not to take any coercive
measures or arrest the couple while the investigation is ongoing.
Additional
Controversies: Prior to these asset-related allegations, the BJP filed a
complaint against Aditi Munshi with the Election Commission during the assembly
elections. They accused her of violating the Model Code of Conduct by having a
foreign national (a Nigerian footballer) actively participating in her election
campaign.
The
disproportionate assets case against Aditi Munshi and Debraj Chakraborty
involves allegations of amassing ₹100 crore in wealth over five years despite
vastly lower declared incomes. The legal battle escalated at the Calcutta High
Court on May 22, 2026, revealing specific financial numbers and legal arguments
from both sides.
Specific
Financial Allegations :The declared Income vs. Acquired Wealth Gap.
State
Additional Advocate General Rajdeep Mazumder submitted that over the last five
years, Aditi Munshi’s declared income was ₹40 lakh, and Bidhan Nagar Municipal
Corporation Councilor Debraj Chakraborty’s declared income was ₹66–67 lakh.
Despite this combined declared income of roughly ₹1.07 crore, they are accused
of amassing properties and assets worth over ₹100 crore.
Luxury
Vehicle Purchases: The state prosecution highlighted that the couple spent ₹71
lakh to purchase three luxury cars.
Benami
Transactions and Asset Disposals: The state claims that just prior to the state
assembly elections, the couple hurriedly disposed of multiple land holdings and
assets through benami transactions, undervalued sales, and gifts. The
prosecution alleges this was intentionally done to hide their true wealth and
present a "cleaner asset affidavit" to the Election Commission.
Origins of
the Police Case & The Whistleblower: The initial complaint was filed by BJP
leader Tarun Jyoti Tiwari, who contested and won the Rajarhat-Gopalpur assembly
constituency seat.
The
Concealment: Tiwari’s complaint at the Baguihati police station asserted that
Munshi intentionally omitted a vast network of land purchase and sale records
in Kolkata and surrounding areas from her Form 26 election affidavit.
The FIR
Timing: Although the complaint was submitted prior to the elections, the Bidhan
Nagar City Police registered the formal First Information Report (FIR) on May
19, 2026, after the election results
were declared.
Legal
Arguments and Defense--Not an "Organized Crime": Represented by
Senior Advocate Bikash Ranjan Bhattacharyya, the defense argued that
transferring, gifting, or selling personal property is completely legal. They
argued that the state cannot arbitrarily claim the wealth came from "extortion
or land grabbing" without concrete evidence.
Jurisdiction
of Income Tax: The defense maintained that any discrepancy or non-disclosure of
income is a civil tax matter under the purview of the Income Tax Department,
rather than a criminal matter under state police. They labeled the case as a politically
motivated witch-hunt following the shift in political power.
Current
Court Status: Justice Jay Sengupta of the Calcutta High Court has ordered the
investigating officer to submit a detailed progress report regarding the asset
trail. While the investigation continues, the court has given the couple
temporary relief by verbally directing the police not to take any coercive
actions or arrest them until the next formal hearing on June 19, 2026.
Trinamool
Congress (TMC) youth leader and Bidhan Nagar Municipal Corporation councilor
Debraj Chakraborty is embroiled in several other serious legal cases, ranging
from corruption and scam involvements to post-poll violence. His legal troubles have intensified
considerably following recent administrative crackdowns and the conclusion of
the 2026 assembly elections.
The primary
ongoing investigations and cases against him include: Bidhan
Nagar Corruption, Recruitment, and Tender Scam
The Arrest:
Chakraborty was arrested by State Police and the Intelligence Branch on May 19,
2026.
The
Allegations: He faces deep scrutiny over widespread corruption related to
illegal recruitment and tender procurement irregularities within the Bidhan Nagar
Municipal Corporation.
CBI Raids:
This builds upon previous operations, including raids conducted by the Central
Bureau of Investigation (CBI) at his residence regarding his alleged connection
to the broader West Bengal school recruitment scam & 2021 Post-Poll
Violence and Murder Investigation.
The Custody
Interrogation: While in custody, Chakraborty was heavily detained and
interrogated regarding old allegations from the 2021 assembly elections.
The
Prasenjit Das Case: The CBI previously summoned and interrogated Chakraborty
under the orders of the Calcutta High Court over the unnatural death/murder of
BJP worker Prasenjit Das (Biswas).
The
Context: Das was found hanging outside his home in Baguihati amid heavy
political tensions following the 2021 election results. His family alleged he
was tortured by TMC elements, dragging Chakraborty's name into the active
probe.
Extortion
and Promoter Assault Case (Syndicate Raj) &The Close Associate's Arrest: On
May 19, 2026, the Baguihati police arrested Amit Chakraborty (alias Noni),
widely identified as Debraj Chakraborty's "right-hand man".
The
Accusation: The case involves a local promoter, Kishore Haldar, who alleged
that Debraj’s syndicate demanded an extortion amount of ₹50 lakh to ₹1 crore
for a project in Raghunathpur.
The
Violence: Haldar claimed that after he paid a partial sum of ₹3 lakh, he was
violently beaten with iron rods and gun butts by Debraj's associates for
failing to clear the remainder. The police are actively investigating Debraj's
direct operational link to this extortion racket.
2026
Election Counting Day Violence:
The
Incident: Separate police complaints were lodged against Chakraborty following
counting day on May 4, 2026.The Accusation: He and other Bidhan Nagar councilors
are accused of conspiring and deploying field workers to forcibly intercept and
assault the BJP's victory procession after his wife, Aditi Munshi, lost her
assembly seat.
It is known
in the TMC party circle that Debraj is very close to Abhishek Banerjee, and he
is one of the few who has all time access to Abhishek’s residence named ‘Shantiniketan’.
What
Emerge: I think that ‘ME LORD’ can isolate the cases. Debraj shall be
immediately arrested, and kept under Police Custody for interrogations. Aditi
may be free till her case got nailed by trail of transactions, particularly
when she is a young mother.
