The Chief Minister Adhikari-led BJP government in West
Bengal is set to table three major, highly debated legislative bills during the
ongoing state budget session. These upcoming laws aim to radically tighten
public security, recover public losses, and implement long-standing ideological
promises.
1.0-West Bengal Public Safety and Control of Anti-Social
Activities Bill, 2026:
This
proposed law mirrors strict legislation currently implemented in BJP-ruled
states like Uttar Pradesh and Gujarat:
Preventive
Detention: It grants the administration powers to enforce up to 12 months of
preventive detention without trial for individuals deemed a threat to public
order.
Repeated
Detention: The bill enables authorities to issue fresh, repeated detention
orders against an individual upon release if there is a reasonable apprehension
of continued anti-social behaviour.
Broad
Definitions: "Anti-social activity" is heavily expanded to include
any act that causes alarm, widespread danger to property, obstruction of
business or trade, and unlawful dispossession of movable or immovable property.
2. West
Bengal Maintenance of Public Order (Amendment) Bill, 2026:
This bill
introduces aggressive financial penalties to deter vandalism during protests
and political agitations:
Property
Seizure & Auction: If an offender is convicted of damaging public or
private property during a riot, strike, or protest, the state can seize and
auction their personal property to compensate for the losses.
Claims
Commissions: The government will set up specialized Claims Commissions at
various locations to finalize damages, and their rulings cannot be appealed in
traditional courts.
3. The
Uniform Civil Code (UCC) Bill Fulfilling a core election manifesto promise, the
BJP administration is moving forward to legally implement the Uniform Civil
Code in West Bengal:
Standard
Procedure: CM Adhikari announced that the state will follow a formal legal
process overseen by a judge-led committee, identical to the frameworks executed
in Uttarakhand, Gujarat, and Assam.
Additional
Pledges: Alongside the UCC, the Chief Minister stated that strict legislative
frameworks targeting "love jihad", "land jihad", and forced
religious conversions are also under draft review.
Opposition
Backlash: The Trinamool Congress (TMC) has fiercely opposed the introduction of
the security bills, with senior leaders like MP Kalyan Banerjee publicly
condemning the legislation. The opposition alleges that these bills are driven
by "political vendetta" and designed to suppress political protests
across the state.
