COCKROACH BULLETIN Dt.14/10/26
SARASIJ MAJUMDER
Mis-information
are wildly circulated about ‘JUDICIAL ARREST’ of two Cockroach Leaders, in
social media, including lead National & International Newspapers.
It calls for
proper information.
Which
Cockroaches are arrested?
The
individuals arrested are leaders and activists of India's Gen Z-led Cockroach
Janta Party (CJP). Most recently, top leaders Saurav Das and Ashutosh Ranka
were formally arrested and sentenced to five days of judicial custody.
Current
Status of the Arrests:
• Saurav Das
& Ashutosh Ranka (Currently Jailed): Arrested after climbing barricades to
unfurl the national flag at Jantar Mantar. A magistrate remanded them to five
days in jail on charges of trespassing, violating prohibitory orders, and
obstructing public officials.
They are in
judicial custody and have been sent to Tihar Jail.
In India's
legal system, these two terms work together in this scenario:
• The Legal
Status: A Special Executive Magistrate remanded them to five days of judicial
custody, meaning they are under the authority of the court rather than being
held for interrogation by the Delhi Police (which would be police custody).
• The
Physical Location: Because they were remanded to judicial custody, they were
physically jailed and lodged inside Tihar Jail to serve out those five days.
The court
ordered this five-day period due to police apprehensions that the leaders would
repeatedly violate peace bonds and continue instigating unauthorized protests
at the denotified Jantar Mantar site.
The Delhi
Police have registered two separate First Information Reports (FIRs) against
Saurav Das, Ashutosh Ranka, and 12 other Cockroach Janta Party (CJP) members.
Because the incident took place in October 2026, they are charged under India's
new criminal code, the Bharatiya Nyaya Sanhita (BNS), rather than the old
Indian Penal Code (IPC).
The specific
legal charges and provisions filed against them are broken down by the two
registering police stations:
1. Connaught
Place Police Station FIR
This FIR
focuses primarily on how the leaders allegedly bypassed security to enter
Jantar Mantar through adjacent private premises. The specific BNS charges are:
• Section
223(a): Disobedience of an order duly promulgated by a public servant (for
violating the prohibitory orders banning assembly at the site).
• Section
332: House-trespass to commit an offence punishable with imprisonment.
• Section
61(2): Criminal conspiracy.
2.
Parliament Street Police Station FIR
This FIR
relates to the physical confrontation that ensued when security personnel
attempted to stop the group. The specific BNS charges are:
• Section
221: Obstructing a public servant in the discharge of their official functions.
• Section
132: Assault or criminal force to deter a public servant from discharge of his
duty.
• Section
115(2) & Section 121(1): Voluntarily causing hurt, and voluntarily causing
hurt to deter a public servant from their duty.
• Section
3(5): Joint liability for acts committed by several persons in furtherance of a
common intention.
Preventive
Arrest & Peace Bond Violations
Separate
from the formal FIR penal charges, the police also initiated preventive action
under the Bharatiya Nagarik Suraksha Sanhita (BNSS):
• Section
126 & Section 170 (BNSS): These sections govern preventive arrest to stop a
person from committing a cognizable offence or breaching public peace.
• Breach of
Peace Bond: Just days prior, both leaders had signed a legal undertaking (peace
bond) promising to maintain good behavior for a year. The police successfully
argued before the magistrate that by immediately scaling the gates at Jantar
Mantar, the leaders intentionally violated that bond and used social media to
incite others to do the same.
• Abhijeet
Dipke (Released): The founder of the movement was initially arrested directly
off a commercial flight upon landing in New Delhi. He was released by a court
the following day after committing to a peace bond.
• Thousands
of Activists: Between 3,000 and 7,000 student protesters and youth volunteers
have been systematically detained, bussed away. Some are arrested by Delhi
Police during the ongoing city-wide clampdowns who have past criminal records.
